DESIGN UPLOAD & CONTENT POLICY

By using the Site, you agree that all content, designs, images, artwork, text, or other materials you upload, store, transmit, or use on the Site (“Designs”) fully comply with this Policy. You accept full responsibility and liability for any Designs that do not comply.

Please read this Policy carefully. By accessing or using the Site, you agree to be bound by this Policy and by any additional guidelines, restrictions, or rules posted in connection with specific features or services. All such rules are incorporated into this Policy by reference.

The Pro Jersey reserves the right to modify the Site and this Policy at any time without prior notice.

I. TERMS AND CONDITIONS

1. Ownership & License Grant

You retain ownership of any Designs you submit. By uploading a Design, you grant The Pro Jersey and its designees a worldwide, non-exclusive, transferable, sublicensable, royalty-free, perpetual, and irrevocable license to:

Use, reproduce, distribute, display, and create derivative works of your Designs
Use the Designs solely to fulfill your requested products or services
Display previews showing how your Designs appear on our products

For example, when you place an order, we may prepare, modify, transmit, and reproduce the Design for production, packaging, shipping, and fulfillment.

You also grant The Pro Jersey a non-exclusive, worldwide, transferable, sublicensable right to use your Designs for advertising, marketing, promotional, and sample purposes, including but not limited to:

Displaying your customized products
Featuring Designs in promotional images, videos, or product galleries
Placement in marketing materials, magazines, television, film, or digital media
Promotion through third-party platforms, feeds, or advertising channels

2. Site Content Ownership

While you retain ownership of your Designs, the Site contains graphics, templates, images, layouts, fonts, text, software tools, and other materials (“The Pro Jersey Content”).

All Site content is the copyrighted property of The Pro Jersey and/or its licensors. All rights are reserved worldwide.

You may not copy, reproduce, distribute, publish, store, or use any portion of The Pro Jersey Content except as expressly permitted by this Policy. Any modifications to Site content remain the property of The Pro Jersey and its licensors.

3. Representations & Warranties

By uploading a Design, you represent and warrant that:

You own or have all necessary rights, licenses, permissions, and consents to use the Design
The Design does not infringe or violate any copyright, trademark, trade secret, privacy, publicity, or other proprietary rights
The Design does not violate any applicable laws
The Design does not contain fraudulent, threatening, abusive, defamatory, obscene, or otherwise objectionable material
There are no existing disputes related to the ownership or rights of the Design

4. Use of Likeness & Minors

You consent to the use of your likeness if it appears in a Design.

If a Design contains an identifiable individual, you confirm that you have obtained written consent, release, or permission from that individual. If the individual is under eighteen (18), consent must be obtained from a parent or legal guardian.

You agree to provide proof of such consent upon request. We strongly discourage including identifying information (such as names or addresses) of minors in any Design.

5. Design Review & Compliance

All uploaded Designs are automatically stored by The Pro Jersey. We do not pre-review Designs before upload. Uploading a Design does not imply compliance with this Policy.

You assume full responsibility for all uploaded Designs and their compliance.

Designs submitted with an order may be reviewed. The Pro Jersey reserves the right to:

Refuse to use any Design
Suspend production, processing, or shipping
Request written proof of rights, permissions, and licenses

Failure to provide satisfactory documentation may result in removal of Designs or suspension or termination of your account.

We may disclose Designs and related information to third parties to fulfill services, enforce this Policy, or comply with legal obligations.

6. Indemnification

You agree to indemnify and hold harmless The Pro Jersey, its directors, officers, employees, contractors, affiliates, agents, and partners from all claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising from:

Your violation of this Policy or applicable laws
Your Designs
Your use of the Site or services
Any activity conducted through your account

7. Removal & Backup Responsibility

Designs that violate this Policy may be removed at our discretion. We are under no obligation to remove Designs upon user request and are not liable for any removal or loss.

You are responsible for maintaining backup copies of your Designs.

II. INTELLECTUAL PROPERTY NOTICES

All trademarks not owned by The Pro Jersey are the property of their respective owners. Our trade names, trademarks, and service marks may not be used without prior written consent.

Nothing on the Site grants any license or right to use our intellectual property unless expressly stated.
